Article 2 — Purpose

These general terms and conditions of sale govern all sales of handcrafted tufted creations (rugs, wall art, cushions, accessories), maintenance products, and workshops offered on the site clotopia.odoo.com.

Any order placed on the site implies full and unconditional acceptance of these GTC.

Article 3 — Products

Clotopia creations are handcrafted one by one. Slight variations in colour or texture between the visuals presented on the site and the product received are inherent to the artisanal manufacturing process and do not constitute a defect.

Made-to-order products are manufactured only after validation and payment of the order. Each piece is unique.

Article 4 — Price

Prices are indicated in euros. Clotopia being exempt from VAT in accordance with article 293 B of the CGI, no VAT is applied to sales.

Clotopia reserves the right to modify its prices at any time. Products are billed at the price in effect at the time of order validation.

Article 5 — Order

The order is validated after payment confirmation. A confirmation email is sent to the customer at the address provided during the order.

Clotopia reserves the right to cancel any order in case of force majeure, a manifest error on the price, or unavailability of the product. The customer will be informed by email and fully refunded.

Article 6 — Payment

Payment is made online by credit card via Stripe, a secure payment platform. The debit is made at the time of order validation.

Clotopia does not store any banking data.

Article 7 — Delivery

Orders are shipped via Colissimo or Mondial Relay according to the customer's choice at the time of the order.

For custom creations, a manufacturing time of 2 to 6 weeks is added before shipping. The customer is informed by email of the shipment of their order.

Any customs duties, import taxes, or additional fees payable outside the European Union are the sole responsibility of the customer.

Clotopia cannot be held responsible for delays attributable to the carrier.

Article 8 — Right of withdrawal

In accordance with Article L221-28 of the Consumer Code, custom or made-to-order creations are expressly excluded from the right of withdrawal.

For standard products available in stock (Maintenance Kit, non-customised accessories), the customer has a period of 14 days from the receipt of the package to exercise their right of withdrawal, without having to provide a reason.

Return shipping costs are the responsibility of the customer. The product must be returned in its original condition, unused and in its original packaging. The refund will be processed within 14 days after receipt of the return.

Article 9 — Legal warranties

Every product benefits from:

- The legal warranty of conformity (articles L217-4 and following of the Consumer Code)

- The warranty against hidden defects (articles 1641 and following of the Civil Code)

These warranties do not cover damages resulting from incorrect use or maintenance not in accordance with the recommendations available on the site.

Article 10 — Maintenance and liability

The maintenance advice available on the Maintenance page of the site clotopia.odoo.com must be followed to preserve the quality of the creations. Clotopia cannot be held responsible for damages resulting from inappropriate maintenance.

Article 11 — Intellectual property

All visuals, creations, patterns, texts and content published on the site clotopia.odoo.com are the exclusive property of Clotopia. Any reproduction, representation or use, even partial, is strictly prohibited without prior written permission.

Article 12 — Personal data

The personal data collected during the order (name, address, email, phone) is used exclusively for processing and tracking the order.

In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify, delete, and transfer your personal data. To exercise these rights, contact: clotopia.arts@gmail.com

Your data is never sold or passed on to third parties, except for the providers necessary for the execution of the order (carriers, payment platform).

Article 13 — Mediation and disputes

In the event of a dispute, an amicable solution will be sought as a priority by contacting Clotopia at the address clotopia.arts@gmail.com

In the absence of an amicable resolution, the customer can resort free of charge to a consumer mediator. In accordance with Article L612-1 of the Consumer Code, Clotopia adheres to the following mediation service: CM2C — Consumer Mediation Centre of Justice Conciliators

Failing that, the courts of Versailles will have sole jurisdiction.
